DR Congo Parliament Lifts Kabila’s Immunity Amid Allegations of Rebel Ties

In a historic and controversial move, the Democratic Republic of Congo’s (DRC) parliament has voted to lift the lifetime immunity of former President Joseph Kabila, a decision that opens the door to potential prosecution. Kabila, who ruled the mineral-rich central African country from 2001 until 2019, is facing serious allegations of aiding the M23 rebel group, which has been embroiled in the ongoing conflict in the country’s troubled east.

In a secret ballot held late Thursday, 88 lawmakers voted in favour of revoking Kabila’s immunity, with only five opposed. Allegations of Rebel Ties

President Tshisekedi last year publicly accused his predecessor of covertly aiding the M23 rebels, a group that re-emerged in recent years and has since captured significant territory in the eastern provinces, including Goma and Bukavu. Tshisekedi claimed that Kabila played a role in helping the rebels organise a potential insurrection against the state.

Although Kabila has denied the accusations, the allegations have triggered a wave of political and legal action against him and his allies. Last month, authorities suspended the operations of Kabila’s People's Party for Reconstruction and Democracy (PPRD) and initiated proceedings to seize assets held by its top leadership.

His eventual decision not to seek re-election in 2018, after considerable domestic and international pressure, led to the election of Tshisekedi in what was then considered the first peaceful transfer of power in DRC’s history. However, relations between the two leaders have since soured.

Kabila has spent much of the past two years residing in South Africa, mostly staying out of the spotlight. He has periodically spoken about the need to end the eastern conflict and stabilise the nation, particularly in the resource-rich regions plagued by rebel groups. However, the recent allegations paint a starkly different picture, potentially undermining his legacy as a former head of state and peacemaker.

Ongoing Conflict in the East

The backdrop to this political showdown is the worsening humanitarian and security crisis in eastern DRC. The M23 rebel group, which had largely been dormant after a 2013 peace deal, resurfaced in 2021 with renewed aggression. Backed by what the Congolese government claims are 4,000 Rwandan troops, the rebels have captured strategic towns, including Goma — the capital of North Kivu province — and more recently, Bukavu.

Both the M23 and the Congolese military have faced accusations of human rights abuses and war crimes. Despite international mediation efforts and a recent agreement to work toward a ceasefire, clashes continue, especially in South-Kivu province.

Eastern DRC is home to vast reserves of cobalt, gold, coltan, and other valuable minerals, making control of the region both a strategic and economic imperative for any political or armed actor. With more than 100 armed groups operating in the area, the conflict has become a protracted battle for dominance and resources, often with devastating consequences for civilians.

What Comes Next?

The parliamentary decision to lift Kabila’s immunity is likely to further polarise Congolese politics. Supporters of President Tshisekedi see the move as a necessary step in upholding justice and addressing the root causes of conflict in the east. Detractors argue that it is a politically motivated stunt designed to weaken the opposition and deflect from the government’s inability to bring peace and stability to the country.

Whether prosecutors will succeed in building a robust legal case against Kabila remains to be seen. Nevertheless, the vote sets a powerful precedent: no one, not even a former president, is above scrutiny in today’s DRC.
